A loss of consortium claim by the husband is less valuable where he is consorting with other women. A plaintiff's claim for dyspareunia or painful sex is less valuable if the plaintiff is able and having sex with other partners.
That's something I wanted to know when my client was asked this question at her deposition.
I was told by one of my clients' husbands that he was unfaithful to his wife. His wife had dementia so she did not recall his having been unfaithful.
